and Abandoned: Seduction in Canadian Law

The
Windsor courtroom was packed for the May 1907 sittings
of the Court of King’s
Bench. The crowd had not gathered for a sensational
murder or rape trial but for a “heartbalm”
case. These trials concerned lost loves, broken promises
and in 1907, an injured party had a right to sue a faithless
lover.
What made this particular case more interesting was
that the grief-stricken lover was a man, young Mister
George Murray of Windsor. He was suing a Miss Pinkham
who had changed her mind about marrying George. The
trial judge suggested that perhaps they might want to
patch up their quarrel in private. To the delight of
the crowd, George declined the suggestion and “replied
that he wanted a judgment and did not desire to go with
the girl again.” An indignant Miss Pikham replied
“there was no danger of that.”
Throughout the 1800s and well into the 20th Century,
Canadian courts tried heartbalm cases. While they delighted
the curious, these cases were the only way that the
family of a woman who was bearing a child out of wedlock
could recover money from the father. Patrick Brode,
a local lawyer, has published the first study of the
heartbalm cases entitled Courted and Abandoned: Seduction
in Canadian Law
(University of Toronto Press, $35.)

A journal kept during the last weeks in the life of Nathalie,
the authors husbands niece and continued for two
months after her death. Nathalie died at the age of 24 on
December 23, 1999 at Metropolitan Hospital in Windsor, Ontario
of Non-Hodgkins Lymphoma.
